Membership Terms

The undersigned member understands that upon signing of this agreement, he/she has full membership rights to GETFIT ANYTIME fitness center so long as member is current with payments outlined in this agreement, irrespective of the amount of service the undersigned uses the fitness center. He/she also does acknowledge and agree to follow the rules and regulations set forth within this agreement and any additions, changes, or amendments thereto by GETFIT ANYTIME, Springfield, TN does hereby agree to give the undersigned the right to its facilities during regular hours. It is also agreed that GETFIT ANYTIME reserves the exclusive rights to reject this application at anytime during the term of this agreement, and the revocation of any of the terms of this agreement by a court of law shall not serve to cancel the entire agreement, which shall remain in full force and effect. This agreement is not transferable.

Cancellation Terms

Monthly Members can cancel at anytime with 30 days written notice to GETFIT ANYTIME, 3538 Tom Austin Hwy, Springfield, TN 37172, and with no cancellation fee.

Key Fobs

Key fobs/membership cards are property of GETFIT ANYTIME and must be surrendered upon cancellation. If the key is lost, stolen, or damaged, there will be a $10.00 replacement fee. If the key is not returned to GETFIT ANYTIME at the end of your membership, you will be billed $10.00.

Guests

Members may bring a guest only during staff hours and only after arranging for a pass with club staff.

Notices

1. GETFIT ANYTIME urges all members to obtain a physical examination from their physicians prior to the use of any exercise equipment or attendance in any exercise class. In recognition of the possible dangers connected with any physical activity, member(s) hereby knowingly and voluntarily waive their right or cause of action of any kind whatsoever arising as the result of such activity from which any liability may or could accrue to GETFIT ANYTIME, its officers, owners, agents, employees, or instructors.
2. GETFIT ANYTIME is not responsible for any loss of your personal property.
3. FAMILY MEMBERSHIP INDEMNIFICATION________+________ (member initials) If "Family" is the membership plan checked on the first page of this agreement, member agrees that each member of my family covered under this agreement also agrees to assume the risk of injury as stated above and member indemnifies and holds harmless Club Owner and GETFIT ANYTIME and their respective owners, employees, agents, successors and assigns from any claim for injury and damages brought by my family members. Moreover, we are aware that only family members listed on this agreement may use the club. A family member must be at least 16 years old to use the club alone. A family member between ages 14 and 15 can use the club only under the supervision of an adult member 18 years or older. Family memberships are limited to immediate family members (spouse and qualified dependents).
4. You have agreed to purchase a membership at a facility that allows you access at any time. As such, you are aware that there will be no supervision or assistance. You are also aware that if you are injured, become unconscious, suffer a stroke or heart attack, that there will likely be no one to respond to your emergency and this facility has no duty to provide assistance to you. Even though this facility is equipped with surveillance cameras, it is likely that should you require immediate assistance, none will be provided. We HIGHLY recommend that you have a workout partner accompany you while at the club, but that is entirely up to you.
5. This waiver and release of liability includes, without limitation, all injuries which may occur, regardless of negligence, as a result of; (a) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment and (c) your slipping and/or falling while in the club, or on club premises, including adjacent sidewalks and parking areas.
6. You acknowledge that you have carefully read this "waiver and release" and fully understand that it is a release of liability. You expressly agree to release and discharge the club, and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring legal action against the club for negligence, personal injury or property damage.
